Since 1971 the senior partner of the firm Mr. Tony Mostert, has practised as an attorney without interruption. His practice has been varied and he has gained experience in most spheres of a commercial and corporate nature. For the past 30 years he has specialised in the recovery of large claims on behalf of various banks, financial institutions and individuals, both locally and abroad. These recoveries involved insolvency enquiries as well as the recovery and seizure of assets internationally. During the past 15 years he has gained experience in dealing with a wide range of matters involving pension funds and the administration thereof.
He has also been involved in matters relating to large number of insolvencies as well as investigations relating to the commercial transactions of private and public companies, and the recovery of funds locally and abroad. Mr Mostert has also been involved in multi-million Rand foreign exchange investigations in close co-operation with the Reserve Bank of South Africa and the Commercial Branch of the South African Police Services.
In 2005, he was appointed as the curator of Mitchell Cotts Pension Fund, pursuant to earlier investigations that he and the FSB Inspectorate had made which exposed what became known as the Ghavalas option. In his curatorship of Mitchell Cotts, a number of similar pension fund surplus stripping schemes were uncovered and due to Mr. Mostert’s in depth investigations, knowledge and understanding of surplus stripping, he was appointed in several pension funds such as the SACCAWU National Provident Fund.. Mr. Mostert’s involvement in that Fund is widely reported on in various reports to court and summarised in the judgement of Bertelsmann J (April 2011).

Nicky holds a B.Proc degree and a Diploma in Corporate Law from the University of Johannesburg (formerly Rand Afrikaans University) and was admitted as an attorney of the High Court of South Africa on 1 April 1999. Nicky has been in continuous practice ever since. Nicky is also admitted as a non-practising solicitor in the United Kingdom, Northern Ireland and Wales.
Nicky has been a partner and director of AL Mostert & Company Inc. During her practice as an attorney, she has gained substantial experience in various commercial matters, commercial litigation, administration of deceased estates, sequestrations, liquidations, matrimonial law, labour law and general litigation. Over the past 15 years however the firm has specialized in pension fund work and Nicky has gained substantial knowledge and expertise in this field in particular in relation to the commercial litigation side of recovering assets for the distressed funds.
For approximately the past ten years Nicky has been intricately involved in litigation pertaining to the financial services industry and in particular that relating to pension funds and curatorships. Nicky has been the attorney of record in various litigation matters pertaining to the Saccawu National Provident Fund, Corporate Money Managers (Pty) Limited, the Sable Industries Pension Fund, the Cadac Pension Fund and the Powerpack Pension Fund, all under curatorship.
